By signing up and/or using the Swag Platform, you agree to be bound by these Terms of Use. These Terms of Use may be updated by Swag at its sole discretion, and the latest version along with the revision date will be available on the Swag Platform. Your continued use of the Swag Platform after such changes constitutes your acceptance of the revised Terms of Use. You are responsible for reviewing these Terms of Use regularly.

1. Definitions

1.1

The User has confirmed that Swag possesses the necessary knowledge and competence to provide its services.

1.2

The User agrees to protect and keep "Access Credentials" confidential, acknowledging that disclosure to third parties is at their own risk. Users must not disclose credentials to others, agree not to share them, and commit to taking reasonable measures for confidentiality, including regular password updates and ensuring complexity.

1.3

The User acknowledges that Swag is not responsible for transactions resulting from misuse of Access Credentials. Users must implement security measures to prevent unauthorized access to their Swag Platform account, and Swag will not be liable for such access.

1.4

The User authorizes Swag to transmit requests made via their Swag Platform account, authenticated by Access Credentials, for executing instructions related to purchasing, redeeming, switching, selling, or other transactions/activities on the Swag Platform, whether directly or through a Commercial Partner, as per the terms.

1.5

The User confirms that they are availing Swag's execution services voluntarily and have not been compelled to do so.

1.6

The User understands that using Swag Services or investing through Commercial Partners may incur tax incidence and liability. The User acknowledges availing services after considering potential tax implications.

1.7

The User agrees not to hold Swag, Swag Group Entities, its directors, officers, representatives, or employees liable for any claim, loss, damage, expense, or legal breach resulting from the User's decision to utilize Swag Services, whether directly or through Commercial Partners.
